Friendly Reminder About Burn Laws
Fauquier County no longer has its own 4 p.m. burn restriction. Please refer only to the statewide law section 10.1-1142(b).
Between February 15 through April 30 of each year burn only between 4 p.m. and midnight. Just remember: The fire must be out at midnight!
In reference to Controlled burning:
1. Property maintenance (fence clearing, cleaning up trees and large limbs, and land/lot clearing = permit needed from the Fire Marshall (540-422-8800 or 540-422-8823)
2. Residential burning with a pile bigger than 15 ft. x 15 ft. x 15 ft. = permit needed from the Fire Marshall (540-422-8800 or 540-422-8823)
3. Residential yard/garden debris. Open burning is allowed for the disposal of leaves and tree, yard and garden trimmings located on the premises of private property. Fires must be reported to the Fauquier County Communications Center (540-347-1313) prior to ignition. The responsible party shall stay with the fire until it is extinguished completely.
4. All burning must be at least 500 feet from another person’s buildings, 50 feet from any right of way, reported to communications prior to ignition, and burning shall be attended at all times.5. It is illegal to burn anything in a ditch along a public or private right of way.
