Fauquier County Open Burn Law – Starts February 15
Attention Fauquier County residents! The 4 P.M. Burn Law goes into effect February 15 – April 30. During this period, all open burning is only allowed between 4:00 PM and midnight and must be completely out by midnight.
IMPORTANT:
Notification Required – Before burning (permit or not), you MUST notify the Fauquier County Emergency Communications Center at (540) 347-1313.
Residential Burning Rules – Burning of yard debris, tree, and garden trimmings is permitted if:
- Fire is at least 50 feet from any structure
- Fire is 500 feet from any occupied building (unless you have permission)
- Fire is constantly attended & does not cause a nuisance
- No saw wood or non-vegetative materials
Do You Need a Permit?
- No Permit Needed – If burning yard debris, leaves, tree, or garden trimmings in a pile smaller than 15’x15’x15’.
- Permit Required – If burning for land clearing, property maintenance, or piles larger than 15’x15’x15’. A physical inspection is required. Call the Fire Marshal’s Office at (540) 422-8800 (M-F, 8 AM – 4 PM) to obtain a FREE permit.
